Scottish Power UK plc sought our expert advice on the legal and policy authorisation framework relevant to an application under the Electricity Act 1989, Section 36. The application was to construct, as an extension to an existing station, a further 800MW of CCGT generating capacity.
We provided strategic advice as to the relevant consenting regime and the constituent parts of the application and accompanying environmental statement. Our advice included robust programme and cost estimates. We highlighted the need to address the UK’s energy, climate change and national and local planning policies. We also identified other material considerations which added weight to the project. Finally, we identified legal risks and made recommendations for client endorsement.
Scottish Power sucessfully proceeded with an application and the Secretary of State granted section 36 consent and deemed to grant planning permission. The planning permission has been implemented.
